Final Arguments Presented in Gentles Case

Final arguments were heard yesterday afternoon in the trial of a 30-year old man charged with impaired driving causing death.

Defence lawyer Ken Walker, who is representing defendant Martin William Gentles, says testimony from witnesses has been unreliable and is calling for no guilty charges against his client, which include leaving the scene of an accident.

Walker adds that there is no evidence to suggest that a driver, even sober, would have been able to avoid the collision on Carson Drive that claimed the life of pedestrian Rayael MacDonald on April 22nd, 2012 and critically injured Alysha Mullet.

The crown argues that testimony from witnesses varied because of different perspectives and that Gentles knew he had hit a person but didn’t stop.

The crown also argued that Gentles had perfect memory of the day but no recollection of what he saw or if he hit the brakes before he hit MacDonald.

Justice John Truscott has reserved his decision in the case.

Gentles is due back in court on January 5th.
